Concebir los derechos como una protección no-paternalista de los intereses de sus titulares supone aceptar que su aspecto más relevante consiste en la provisión de una competencia para renunciar o consentir su inobservancia por terceros, lo cual no tiene por qué coincidir con la mejor estimación de sus intereses, aun cuando estos últimos juegan un papel importante en la justificación de las posiciones jurídicas implicadas. A partir de la tesis de la correlatividad, los conceptos jurídicos fundamentales de W.N. Hohfeld y (...) una tesis de la combinación que armoniza los elementos de la voluntad e interés en la explicación de los derechos, en el presente artículo se tratará de mostrar por qué afirmar el carácter inalienable de los derechos contradice la función que estos desempeñan en los ordenamientos jurídicos modernos. // The understanding of rights as non-paternalistic protections of its holder’s concerns entails that the most important aspect of them is the provision of a power either to waive or to consent their encroachment by others, which does not necessarily coincide with the best appraisal of his/her interests, even when they play an important role in the justification of the subjective legal positions. From the correlativity thesis, the fundamental legal conceptions devised by W.N. Hohfeld and a combination thesis that merges the elements of will and interest in the explanation of rights, I will try to show why to stand up for the inalienable character of rights contradicts the function they perform in modern legal systems. Complex technology has become an essential aspect of everyday life. We rely on technology as part of basic infrastructure and repeatedly for tasks throughout the day. Yet, in many cases the relation surpasses mere reliance and evolves to trust in technology. A new, disruptive technology is blockchain. It claims to introduce trustless relationships among its users, aiming to eliminate the need for trust altogether—even being described as “the trust machine”. This paper presents a proposal to adjust the concept of trust (...) in blockchain applications with the tools provided by conceptual engineering. Its goal is to propose a concept of trust, that offers more than a halo term, devoid of the normative depth that the original, philosophical term actually carries. To evaluate possible concepts of trust in blockchain applications, five criteria are proposed: These criteria ensure that the conceptual relation indeed embodies trust, thereby being richer than mere reliance, and that the chosen concept highlights the active role of the trustor. While the concepts of trust in engineers and trust in algorithms have to be discarded, institutional trust emerges as a viable candidate, given some refinements. Ultimately, the concept of trust by normative expectations and attribution is suggested to capture the essence of trust in blockchain applications. (shrink)

It is a consequence of the theory of imprecise credences that there exist situations in which rational agents inevitably become less opinionated toward some propositions as they gather more evidence. The fact that an agent's imprecise credal state can dilate in this way is often treated as a strike against the imprecise approach to inductive inference. Here, we show that dilation is not a mere artifact of this approach by demonstrating that opinion loss is countenanced as rational by a substantially (...) broader class of normative theories than has been previously recognised. Specifically, we show that dilation-like phenomena arise even when one abandons the basic assumption that agents have (precise or imprecise) credences of any kind, and follows directly from bedrock norms for rational comparative confidence judgements of the form `I am at least as confident in p as I am in q'. We then use the comparative confidence framework to develop a novel understanding of what exactly gives rise to dilation-like phenomena. By considering opinion loss in this more general setting, we are able to provide a novel assessment of the prospects for an account of inductive inference that is not saddled with the inevitability of rational opinion loss. In this article, we address a major outstanding question of probabilistic Bayesian epistemology: how should a rational Bayesian agent update their beliefs upon learning an indicative conditional? A number of authors have recently contended that this question is fundamentally underdetermined by Bayesian norms, and hence that there is no single update procedure that rational agents are obliged to follow upon learning an indicative conditional. Here we resist this trend and argue that a core set of widely accepted Bayesian norms is (...) sufficient to identify a normatively privileged updating procedure for this kind of learning. Along the way, we justify a privileged formalization of the notion of ‘epistemic conservativity’, offer a new analysis of the Judy Benjamin problem, and emphasize the distinction between interpreting the content of new evidence and updating one’s beliefs on the basis of that content. Suppositions can be introduced in either the indicative or subjunctive mood. The introduction of either type of supposition initiates judgments that may be either qualitative, binary judgments about whether a given proposition is acceptable or quantitative, numerical ones about how acceptable it is. As such, accounts of qualitative/quantitative judgment under indicative/subjunctive supposition have been developed in the literature. We explore these four different types of theories by systematically explicating the relationships canonical representatives of each. Our representative qualitative accounts of indicative (...) and subjunctive supposition are based on the belief change operations provided by AGM revision and KM update respectively; our representative quantitative ones are offered by conditionalization and imaging. This choice is motivated by the familiar approach of understanding supposition as `provisional belief revision' wherein one temporarily treats the supposition as true and forms judgments by making appropriate changes to their other opinions. To compare the numerical judgments recommended by the quantitative theories with the binary ones recommended by the qualitative accounts, we rely on a suitably adapted version of the Lockean thesis. Ultimately, we establish a number of new results that we interpret as vindicating the often-repeated claim that conditionalization is a probabilistic version of revision, while imaging is a probabilistic version of update. Many of the social deprivations of Mexico will be worsened due to the SARSCOV2 pandemic. Namely, the insufficient access to public health, lack of labor rights, and the unsuccessful government’s response to eradicate male violence against women. The historical unconcern in promoting a culture rooted in mutual aid and self-care has provoked many citizens are disconnected from their social and health rights. Thus, people’s inability to carry through one direction –stay home- is unfulfilled, in part, due to structural inequalities. I (...) affirm that effective liberty could be obtained by approving a Universal Basic Income from a feminist perspective. I conclude that the aftermath of COVID-19, which will define everyday life for a while, require the endorsement of such measure. I present an explanatory argument for the reasons-first view: It is superior to knowledge-first views in particular in that it can both explain the specific epistemic role of perception and account for the shape and extent of epistemic justification.

Current debates about reasons and reasoning often draw comparisons between epistemic and practical reasons and reasoning and presuppose substantial unity between the practical and epistemic domains. This stance seems to conflict with a stark Humean contrast between the two domains: With respect to practical reasons and reasoning, Hume highlights the role of impressions, especially the passions, in motivating and rationalizing action, while apparently downplaying the potential relevance of beliefs, reason, or reasons. With respect to epistemic reasons and theoretical reasoning, he (...) urges us to proportion our belief to the evidence (EHU 10.4), which suggests a significant epistemic role for evidential reasons. My contribution ar-gues that there is nonetheless a convincing and interesting unified Humean account of reasons and reasoning across both domains. To present my case, I first narrow down the unity claim that I am interested in. I then closely engage with Hume’s claims in epistemology, the philos-ophy of action, and metaethics to develop the unified Humean account. (shrink)

The problem of old evidence, first described by Glymour [1980], is still widely regarded as one of the most pressing foundational challenges to the Bayesian account of scientific reasoning. Many solutions have been proposed, but all of them have drawbacks and none is considered to be definitive. Here, we introduce and defend a new kind of solution, according to which hypotheses are confirmed when we become more confident that they provide the only way of accounting for the known evidence.

Proponents of the reasoning view analyze normative reasons as premises of good reasoning and explain the normativity of reasons by appeal to their role as premises of good reasoning. The aim of this paper is to cast doubt on the reasoning view by providing counterexamples to the proposed analysis of reasons, counterexamples in which premises of good reasoning towards φ‐ing are not reasons to φ.

According to influential arguments from several branches of philosophy, there exist some gradable natural language expressions that violate the following principle: if x and y are both F to some degree, then either x is at least as F as y or y is at least as F as x. Dorr, Nebel and Zuehl (2022) (DNZ), who refer to this principle as ‘Comparability’, respond to these arguments and offer a systematic case in support of Comparability. In this paper, I respond (...) to DNZ and develop an opposing case against Comparability that (i) buttresses previous criticisms of the principle, (ii) identifies two new arguments against the principle, and (iii) rebuts DNZ’s prospective arguments in favour of the principle. A partir de los postulados de una concepción semántica de norma y su clasificación en reglas y principios, Robert Alexy ha enunciado una tesis fuerte de la separación, al concebir que entre ambos tipos de normas no solo existe una diferencia gradual, sino también cualitativa. En este contexto, los principios son descritos como mandatos de optimización, caracterizados por un cumplimiento gradual en atención a las posibilidades reales y jurídicas, y a través de la denominada técnica de la ponderación. Subjective rights enjoy limited import in Kelsenian theory for whereas the concept of duty underlies every legal norm, that of rights is merely possible and only emerges when the imposition of the sanction attached to the breach of the duty is made dependent upon a subject's will to bring legal action. The presence of secondary norms establishing certain duties of medical professionals on informed consent displays the existence of correlative reflex rights of patients. Yet, together with secondary norms, Western legal (...) systems typically institute norms of competence enabling patients to take legal action when those duties correlative to their reflex right to informed consent have been infringed. Thus, informed consent constitutes a set of subjective legal positions of patients and medical professionals. Despite its excessive formalism and questionable neutrality, the Kelsenian approach permits to define and clearly distinguish patients' genuine rights from mere aspirations devoid of legal basis. Diversas fuentes culturales explican los orígenes del marcado individualismo imperante en nuestras sociedades actuales. Posiblemente, una de las manifestaciones más aclamadas de este individualismo sea la primacía de la autonomía individual, elemento clave en la articulación y fundamentación de las posiciones jurídicas subjetivas presentes en la práctica totalidad de los ordenamientos jurídicos contemporáneos, y como resultado de la expansión de la cultura occidental. Sin embargo, en ocasiones, el peso otorgado a la autonomía se antoja desproporcionado, especialmente cuando conduce a la (...) inobservancia, ya sea total o parcial, del bien común o alguna de sus manifestaciones, presupuesto de toda relación social y exigencia del principio de justicia. Junto a la autonomía, en tanto que elemento necesario para el florecimiento individual, la búsqueda del bien común debe asimismo servir a la configuración de los diversos instrumentos de decisión política y jurídica que regulan la vida en común, lo que requiere el justo equilibrio de los intereses en juego, tal y como aconseja el principio de proporcionalidad. El paradigma de las enfermedades contagiosas proporciona un claro ejemplo de lo anterior, pues la protección de la salud pública, entendida como una manifestación del bien común, no solo justifica, sino que incluso exige la restricción de ciertas posiciones jurídicas subjetivas que sirven a la especificación de la autonomía individual de sus titulares. Nietzsche’s name has become almost synonymous with militant atheism. Born into a pious Christian family, this son of a Lutheran pastor declared himself the Antichrist. But could this have been yet another of his masks of hardness? Nietzsche rarely revealed his innermost self in the published writings, and this can be gleaned mainly from his private letters and the accounts of friends. These sources bring to light the philosopher’s inner struggle with his own, deeply religious nature.Losing his father at a (...) young age was a calamity from which Nietzsche never recovered, and I argue that his famous thought-image “God is dead” was a transfiguration of the painful memory of this loss. In this essay, I trace Nietzsche’s tortuous path from an ardent devotee of God to a vociferous critic of Christianity, a path that was punctuated with veiled longings for a loving deity. Deep in his heart, he remained faithful to Christian ideals. Rather like Cordelia, the only truly loving daughter of King Lear, Nietzsche refused to utter words of intense affection and reverence, as these had been blatantly devalued and corrupted. Instead, he adopted a mask of a wrongdoer and a blasphemer who took not the punishment but the guilt.Nietzsche’s attitude to religion is discussed from the perspective of his life, his personality, and his mental condition. The discussion draws on psychoanalytical concepts of Freud, Erikson, Winnicott and Kohut. This is not an exclusive reading, but complementary to other studies in this field. (shrink)

The principle of indifference states that in the absence of any relevant evidence, a rational agent will distribute their credence equally among all the possible outcomes under consideration. Despite its intuitive plausibility, PI famously falls prey to paradox, and so is widely rejected as a principle of ideal rationality. In this article, I present a novel rehabilitation of PI in terms of the epistemology of comparative confidence judgments. In particular, I consider two natural comparative reformulations of PI and argue that (...) while one of them prescribes the adoption of patently irrational epistemic states, the other provides a consistent formulation of PI that overcomes the most salient limitations of existing formulations. Aunque presenta un sustrato corporal, este aparece combinado con elementos de índole moral que presuponen una noción concreta de persona como libre y autónoma. Tanto de las definiciones doctrinales como del material normativo se desprende que se trata de una posición jurídica subjetiva del paciente, alternativamente calificada como una “pretensión” o “derecho subjetivo en sentido estricto”, en términos hohfeldianos; un “derecho negativo de defensa”, o una “inmunidad”. En España, el Tribunal Constitucional ha vinculado el consentimiento informado del paciente al derecho fundamental a la integridad física y moral (15 CE), lo cual permite plantear el análisis en clave iusfundamental. Con todo, se advierten dudas e incompatibilidades entre la explicación habitual del consentimiento informado, su fundamento constitucional y su regulación jurídica. El objetivo del presente libro consiste en proporcionar una definición integral del consentimiento informado como derecho subjetivo del paciente y como manifestación de un derecho fundamental, a partir de una óptica poliédrica que aporta certeza en la práctica asistencial y jurídica. // The patient's right to informed consent is inserted within the scope of his decisional autonomy. Although it has a bodily background, it is combined with features of moral nature, which presupposes a concrete notion of the person as free and autonomous. Both, doctrinal approaches and normative legal material show that it is a subjective legal position of the patient, being alternatively qualified as a Hohfeldian “claim” or a “subjective right in a strict sense”; a "negative right" or an "immunity." The Spanish Constitutional Court has linked the informed consent of the patient to the fundamental right to physical and moral integrity (15 CE), which allows us to propose a fundamental rights-based analysis. Nonetheless, doubts and inconsistencies are perceived between the customary explanation of informed consent, its constitutional foundation and its legal regulation. The aim of this book is to provide a comprehensive definition of informed consent as subjective right of the patient and expression of a fundamental right, from a multi-fold perspective that provides certainty in both legal and health care practice. Kim’s causal exclusion argument purports to demonstrate that the non-reductive physicalist must treat mental properties (and macro-level properties in general) as causally inert. A number of authors have attempted to resist Kim’s conclusion by utilizing the conceptual resources of Woodward’s interventionist conception of causation. The viability of these responses has been challenged by Gebharter, who argues that the causal exclusion argument is vindicated by the theory of causal Bayesian networks (CBNs). Since the interventionist conception of causation relies crucially on CBNs (...) for its foundations, Gebharter’s argument appears to cast significant doubt on interventionism’s anti-reductionist credentials. In the present article, we both (1) demonstrate that Gebharter’s CBN-theoretic formulation of the exclusion argument relies on some unmotivated and philosophically significant assumptions (especially regarding the relationship between CBNs and the metaphysics of causal relevance), and (2) use Bayesian networks to develop a general theory of causal inference for multi-level systems that can serve as the foundation for an anti-reductionist interventionist account of causation.1. In this paper we compare Kierkegaard’s and Marx’s views on social reform. Then we argue that Kierkegaard’s own reasoning is consistent with the expression of neighbor-love through collective action, i.e. social reform. However, Kierkegaard’s approach to social reform would be vastly different than Marx’s. We end by reviewing several questions that Kierkegaardian social reformers would ask themselves. Our hope is that this exploration will provide helpful insights into how those who genuinely love their neighbors ought to seek the common good (...) through collective action. (shrink)

Las corrientes intelectuales e ideológicas posthumanistas abogan por la superación de diferentes límites biológicos de la especie humana. La ruptura incluye los asuntos reproductivos, como estrategias para la supervivencia y como cuidado de una dignidad posthumana. En este trabajo, quiero esbozar cuestiones del trans y posthumanismo reproductivo interesado en la gestación subrogada (GS) en sus diferentes modalidades. La GS es relevante para reconducir la reproducción siguiendo criterios promotores de la elección individual. Comienzo subrayando la herencia liberal en el movimiento por (...) la mejora humana y la elección procreativa. Después, sugiero que el posthumanismo reproductivo se apoya en los estudios de género y en la permisividad del comercio sexual para redefinir la GS como probable reproducción posthumana. Así, los objetivos del posthumanismo reproductivo ambicionan una agenda distinta a la feminista. Las perspectivas posthumanas y feministas proponen horizontes de justicia reproductiva que deberán criticarse en contexto antes de que los estados-nación procedan con reformas. (shrink)

Understanding the ethical concerns of paid and altruistic surrogacy requires a knowledge of reproductive freedom and procreative autonomy. An accurate approach must be sensitive enough of the nature of sexual oppression, specifically in its influence in women’s choices, self-identity and personal relationships. The aim of this essay is to stand up for the prominence of radical feminism in questioning reproductive liberalism, which overfocus the interests of the so-called intended parents. Having in mind what egalitarian philosophers have put forward from a (...) social-relational autonomy view to allow surrogacy contracts under certain circumstances —particularly, they suggest that legalization could be compatible with women’s reproductive autonomy following an altruistic fashion under protective measures and supportive to the surrogate’s revocation of consent—, I uphold that radical feminists properly make clear how oppression remains in the cultural environment that endorses surrogacy contracts. A macroscopic methodology, based on American philosopher’s Marilyn Frye metaphor of the caged bird, is a helpful tool to comprehend why surrogacy contracts do not enhance women’s reproductive autonomy, even if they enable some surrogate mothers to gain an income enough to endure tough economic pressure. Here, we show that Base Rate Tracking is strictly weaker than Calibration, and then take up the question of whether it is possible to jointly satisfy Base Rate Tracking and Equalised Odds in non-trivial scenarios. In this paper, I defend a reasons-first view of epistemic justification, according to which the justification of our beliefs arises entirely in virtue of the epistemic reasons we possess. I remove three obstacles for this view, which result from its presupposition that epistemic reasons have to be possessed by the subject: the problem that reasons-first accounts of justification are necessarily circular; the problem that they cannot give special epistemic significance to perceptual experience; the problem that they have to say that (...) implicit biases provide epistemic. The first problem will be overcome by introducing presentational attitudes that are not in need of justification as basic ways of possessing epistemic reasons. The latter two problems will be solved by introducing epistemic rational capacities of two different kinds, which are exercised in mental states that are ways of possessing epistemic reasons, and by distinguishing these from mental states that are not exercises of epistemic rational capacities. Over the past decades, the idea that national sovereignty and the authority of the state have been increasingly challenged or even substantially eroded has been a dominant one. Economic globalization advancing a neo-liberal dis-embedding of the economy is seen as the major reason for this erosion. Concerns have increased about the negative consequences for the social fabric of societies, deprived of the strong shock absorption capacity that the welfare states had established in the time of the embedded liberalism to use (...) a term John Ruggie coined. The concerns have also helped nationalistic movements to gain power in many high-income countries, not at least in the United States, calling for putting their economy first. Accordingly, a number of commentators have announced a return of the nation state. In this special issue, we will show that the retreat-of-the-state thesis as well as the return-of-the-state thesis shares the same shortcomings. They conflate state and authority. As a consequence, both theses underestimate important transformations of authority that have taken place since the end of the “short 20TH century,” to use Eric Hobsbawm's periodization. With this special issue, we seek to contribute to a more nuanced analysis of the transformation of authority. The issue is the outcome of a conference that took place at the Copenhagen Business School in 2015, hosted by the research project ‘Institutional Transformation in European Political Economy: A Socio-Legal Approach’ and funded by the European Research Council. Arlie Hochschild glosses the practice of women migrants in poor nations who leave their families behind for extended periods of time to do carework in other wealthier countries as a “global heart transplant” from poor to wealthy nations. Thus she signals the idea of an injustice between nations and a moral harm for the individuals in the practice. Yet the nature of the harm needs a clear articulation. When we posit a sufficiently nuanced “right to care,” we locate the harm (...) to central relationships of the migrant women. The “right to (give and receive) care” we develop uses a concept of a relational self drawn from an ethics of care. The harm is situated in the broken relationships, which in turn have a serious impact on a person’s sense of equal dignity and self-respect, particularly since the sacrifice of central relationships of the migrant woman allows others (mostly women) to maintain these same relationships. O Tribunal Constitucional configura o consentimento informado como un deber de abstención do profesional sanitario, é dicir, como unha negación da competencia do profesional sanitario na terminoloxía de Hohfeld. Así pois, o consentimento informado queda conformado como un dereito negativo ou de defensa, polo que concibilo como liberdade xurídica ou facultade de (...) autodeterminación positiva esixiría a revisión do seu fundamento constitucional. Al margen de las polémicas sobre su vigencia, se pretende relacionar la aportación de Jellinek con la concepción del consentimiento informado del Tribunal Constitucional español, quien lo ha definido como deber de abstención de los profesionales sanitarios (STC 37/2011, de 28 de marzo, entre otras), es decir, (...) como una negación de su competencia en la terminología de Hohfeld, o como un derecho de defensa. Debido a la adecuación de su estructura al contenido del consentimiento informado, el análisis se centrará en los estatus negativo y positivo. La cuestión versa sobre la posición de los derechos de defensa en la tesis de Jellinek y si es viable su empleo en la conceptualización de los actuales derechos fundamentales. (shrink)

The phenomenon of parental care shared through social media (sharenting) is increasingly widespread. This research aimed to elaborate on the motives, strategies, and psychological effects of sharenting by millennial parents. This research is qualitative research with a phenomenological approach. The subjects are millennial parents who have a habit of sharing parenting on social media and are members of the professional community. Determination of the sample uses purposive sampling so that as many as ten people consisted of five females and five (...) males. Interviews, observations, and documentation are the methods used in data collection. Data were analyzed using reduction techniques, data presentation, and verification. The results showed that the motive of sharenting parents is to receive affirmation and social support, demonstrate the ability to care for children, social participation, and documentation. Millennial parents with a peer-oriented communication model do Sharenting. Sharenting for millennial parents has both positive and negative impacts, namely by providing new information and knowledge, making new friends, and support. The negative effects include feeling insecure, comparing her child with someone else's child, causing animosity and dissent. Thus, it can be concluded that sharenting by millennial parents is carried out with a variety of motives, carried out with a peer approach strategy, and has both positive and negative impacts at the same time. The implication is that millennial parents are more knowledgeable about parenting, understand good sharenting, and are psychologically trained in responding to netizens for their sharenting. Peter Weir's film Gallipoli is a chronicle of the disastrous Dardanelles campaign of the first World War, but it is also a film about racing. Archie is trained by his uncle Jack to run "as fast as a leopard." The film begins as it ends, with Archie sprinting in response to a whistle. Frank is first shown racing after a train, along with friends who are on their way to enlist. Archie and Frank meet while competing in a race, they race in Cairo once they have enlisted, and they finally race death. From the beginning, Archie has been faster; even at the end he is the first to die. And from the beginning he has swept Frank along in his wake, encouraging him, pushing him, inspiring him, and helping him to positions for which he is inadequately qualified. In the end, Archie's compassion and kindness prompt a decision which has grim consequences both for himself and for hundreds of others. Knowing that his friend fears death in the trenches, Archie recommends Frank as a substitute for himself, a designated message runner. But it isn't just the scope of the real human disaster, or the enormity of the blunder, or the pointlessness of the entire enterprise, or even my renewed conviction that stupidity is, in fact, evil, that is so unsettling. In this comment on Katherine Dormandy's paper «True Faith», I point out that the clash she describes between epistemic norms and faith-based norms of belief needs to be supplemented with a clear understanding of the pertinent norms of belief. I argue that conceiving of them as evaluative fails to explain the clash, and that understanding them as prescriptive is no better. I suggest an understanding of these norms along the lines of Ross’s (1930) prima facie duties, and show how this (...) picture can make sense of the clash. (shrink)

Burgess kritisiert Kurt Gödels Begriff der mathematischen oder rationalen Anschauung und erläutert, warum heuristische Intuition dasselbe leistet wie rationale Anschauung, aber ganz ohne ontologisch überflüssige Vorannahmen auskommt. Laut Burgess müsste Gödel einen Unterschied zwischen rationaler Anschauung und so etwas wie mathematischer Ahnung, aufzeigen können, die auf unbewusster Induktion oder Analogie beruht und eine heuristische Funktion bei der Rechtfertigung mathematischer Aussagen einnimmt. Nur, wozu benötigen wir eine solche Annahme? Reicht es nicht, wenn die mathematische Intuition als Heuristik funktioniert? Für (...) Gödel sind Mengen Extensionen von Begriffen und er beharrt beispielsweise auf dem ontologischen Objektstatus von Mengen, weil Denken für ihn einen Input benötigt, den es selbst nicht zu liefern im Stande ist. Im Falle der mathematischen Anschauung darf dieser Input allerdings nicht subjektiv kontingent sein, wenn es sich um objektiv gültige Theorien handeln soll. (Zudem vertritt Gödel eine Korrespondenztheorie der Wahrheit.) Der Begriff der heuristischen Intuition, den Burgess expliziert, stammt hingegen nicht zuletzt aus der kognitiven Psychologie, der bei der Verarbeitung impliziter, also unbewusster Informationen ansetzt und so das menschliche Vermögen erklärt, Entscheidungen und Urteile zu fällen, ohne sich der Urteilsgrundlagen bewusst zu sein. Über den ontologischen oder erkenntnistheoretischen Status dieser Urteilsgrundlagen sagen diese Theorien nichts aus. Sie könnten auch subjektiv kontingent zustande gekommen sein. The logic of indicative conditionals remains the topic of deep and intractable philosophical disagreement. I show that two influential epistemic norms—the Lockean theory of belief and the Ramsey test for conditional belief—are jointly sufficient to ground a powerful new argument for a particular conception of the logic of indicative conditionals. Specifically, the argument demonstrates, contrary to the received historical narrative, that there is a real sense in which Stalnaker’s semantics for the indicative did succeed in capturing the logic of the (...) This paper seeks to defend the thesis that a justification of morality has to underline the role of the second person in addition to a perpetual and on-going change of perspective that likewise includes the third and first person. To support this argument, the paper conceptualises responsibility as a moral relationship whose core constitutes the encounter with the other whom we recognise as a second-person authority. It then sketches how this pre-cognitive dimension must be supplemented by a cognitive insight which (...) implies a dissociation from the second person and a consideration of third persons. on this basis, it finally provides an outline of how a possible tension between these different but all-together necessary perspectives could best be resolved. Although consolation is one of the classic religious subjects it plays no role in the current debate about religious emotions. One reason for this neglect could be that this debate is mostly based on classical emotions such as joy and fear, love and hope, and that consolation is not understood as an emotion. This paper tries to show that consolation in fact can and should be seen as an emotion. After naming and refuting some reasons that speak against taking consolation (...) to be an emotion, I will explain how consolation can be positively conceptualized as an emotion within a recent theory of emotions. It will be decisive to see that the experience of consolation can be understood not only hedonistically-qualitatively, but also intentionally. This structural conception allows for a differentiated description of various types of consolation as an emotion, also, in the tradition of William James, of a secular as well as a religious form of consolation. How should we understand the relationship between global justice and global democracy? One popular view is captured by the aphorism “No global justice without global democracy.” According to Dryzek and Tanasoca's reading of this aphorism, a particular form of deliberative global democracy is seen as the way to specify and justify what global justice is and requires in various contexts. Taking its point of departure in a criticism of this proposal, this essay analyzes how to best understand the relationship between (...) global justice and global democracy. The aim is not to offer a first-order substantial account of this relationship, but to theorize the normative boundary conditions for such an account; that is, the conditions that any plausible theory should respect. These conditions take the form of what is here called a “three-layered view,” which is specified through three claims. It is argued, first, that global democracy is best seen as a partial normative ideal; second, that global democracy must be grounded in fundamental principles of justice; and third, that global democracy is an ideal through which applied principles of distributive justice are formulated and justified in light of reasonable disagreement about what justice requires. The intent of this chapter is to suspend the belief in the goodness of literacy -- our chirographic bias -- in order to gain a deeper understanding of how the engagement with texts structures human consciousness, and particularly the minds of children. In the following pages literacy (a term which in this chapter refers to the ability to read and produce written text) is discussed as a consciousness altering technology. A phenomenological analysis of the act of reading shows the child’s (...) engagement with texts as a perceptual as well as a symbolic event that builds upon but also alters children’s speech acts. Speaking and reading are both forms of language use, but with different configurations of perceptual and symbolic qualities. Children’s literature uses textual technology and, intentionally or not, participates in structuring children’s pre-literate minds. Some of its forms, such as picture books and early readers, are directly intended to bridge the gap between the pre-literate listener and the literate reader and ease the transition into the literate state. It is my hope that the phenomenological analysis of the experiences of speaking and reading might help us understand more clearly how children’s literature impacts the minds of children. Such an analysis can awaken a critical awareness of the power that letters wield as they shape the reader’s psychological reality, and it can sharpen our sense of wonder about the metamorphosis of language from speaking to writing. The aim of this text is to trace the main lines of the interpretation of natural selection in the early phase of reception of the theory of evolution in Serbia, as well as the resistances met by some of Darwin’s ideas. The analysis is directed at the controversies concerning the ideas regarding the evolutionary mechanisms, i.e. the question of natural selection and inheritance of acquired characteristics, as well as the concept of competition, which is of crucial importance for Darwinian natural (...) selection. As a matter of fact, these aspects of the interpretation of Darwin’s theory were very significant for culture in a broad sense and they can be considered as a kind of symptom of the general state of mind.
